AGREEMENT TO TERMS

These Terms & Conditions constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and CKA Consulting LLC DBA Large Scale Containers (“Company“, “we”, “us”, or “our”), concerning your access to and use of the

You agree that by accessing the Site, you have read, understood, and agreed to be bound by these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE, AND YOU MUST DISCONTINUE USE IMMEDIATELY.

PAY ON DELIVERY


Large Scale Containers partners with various vendors worldwide to provide the best services to our customers. If one chooses Pay on Delivery, the following Terms and Conditions apply:

  1. The truck will arrive at your location, and before the driver unloads the container, you must process your payment.

  2. Your logistics coordinator, sales rep, or customer service agent can take this payment over the phone. You can also call us at 385-529-0278 to process your payment.

  3. Payment is due for each container at the time of each delivery.

  4. Once the payment is received in full, the container will be unloaded on your property.

  5. We only accept credit and debit card payments.

  6. Contact your bank the day before delivery to inform them of the large purchase you are about to make.

  7. Refusal of the product does not exempt you from the responsibility of covering the shipping cost of this delivery.

PAY IN ADVANCE


The following applies to payments made in advance of delivery:

  1. Upon receipt of payment, your anticipated delivery date will be within 15 business days.

  2. Our Logistics Department will contact you via email to coordinate the delivery details prior to delivery.

  3. Please allow 4 business days after payment is received to get a delivery date.

  4. Deliveries are scheduled on Monday through Friday.

  5. We do not deliver on weekends or observed holidays.

CANCELATIONS


If an order is canceled within the delivery time frame, a cancellation fee of 5% of the invoice total will be kept from the total refund.   Damages and extra charges to delivery trucks and/or trailers caused by Customer’s on-site conditions shall be paid immediately by Customer upon demand directly to the delivery company or to Seller. (For example, trucks are getting stuck, drivers can’t take turns because of narrowed streets, etc.)   If a customer refuses to pay, the customer authorizes Large Scale Containers to charge the customer's card or bank for the additional fees.

PREPARE YOURSELF FOR DELIVERY


Large Scale Containers is not responsible for any damages to the Customer’s property done by the delivery driver (e.g., ground, lawn, fences, mailboxes, wires, pipes, etc.). The buyer is responsible for clearing out the path of the delivery site so there are no obstacles such as mud, holes, and power cables in the way, having a clear area of at least 120 feet of straight space, and making sure the truck has enough room from the street into the property for unloading for either a 20′ container or a 40′ container or a 45′ container. All trailers are 40 feet long. All trucks are 20 feet long or more. If the truck cannot drive into the customer’s property because the street is not wide enough, the property is wet, snowy, or muddy, there is no clear path for delivery, graded hills, or low bridges coming up to the property from the container depot or any similar situations, it is buyers’ fault, and the buyer should pay the delivery fees for a failed delivery. This includes obstacles like trees, mailboxes, electrical poles, etc.

FAILED DELIVERY

What are the fees for a failed delivery? Those fees are two (2) delivery fees, a cancellation fee and any other 3rd party costs such as potential wrecker or tow costs.

  1. Delivery fee that customer paid to have the container delivered.

    1. Delivery fee from customer’s property back to the depot (warehouse).

    2. Cancellation fee of 5% off the total invoice amount.

    3. Wrecker or tow truck fees, if applicable.


      Please let Large Scale Containers know before delivery if you expect bad weather (including soft/muddy ground) so we can postpone your delivery to avoid any possible damages and charges. In case a customer does not have enough space for the shipping container to be delivered and unloaded, Large Scale Containers will unload the container as close as possible to the customer's property, and it then becomes the customer's responsibility to move the container. If there is no other place to unload the shipping container, the truck driver will take the container back to the depot.

      WARRANTY


      The warranty does not cover the cosmetic appearance. By buying a container from Large Scale Containers, the buyer agrees and is aware that all containers are used and are not limited to having normal use tear of dents, rust, dings, scratches, etc. Buyer agrees, waives, and releases Large Scale Containers from any and all representations and warranties, either expressed or implied, as to any matter whatsoever, without limitation to the design, condition, availability, operation, and fitness for the purchased equipment. Buyer agrees and is aware that Large Scale Containers shall have no liability for any claim, loss, or damage caused directly, indirectly, incidentally, or consequentially by the equipment or by any inadequacy. By receiving delivery of the equipment purchased, the buyer understands and agrees to the container's condition as presented and delivered.

      We cannot guarantee container color on used orders.

      The buyer understands and agrees that all sales are final. No refunds and exchanges are available after the equipment was delivered.

MISCELLANEOUS

These Terms of Use and any policies or operating rules posted by us on the Site or in respect to the Site constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms of Use shall not operate as a waiver of such right or provision. These Terms of Use operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control. If any provision or part of a provision of these Terms of Use is determined to be unlawful, void, or unenforceable, that provision or part of the provision is deemed severable from these Terms of Use and does not affect the validity and enforceability of any remaining provisions. There is no joint venture, partnership, employment or agency relationship created between you and us as a result of these Terms of Use or use of the Site. You agree that these Terms of Use will not be construed against us by virtue of having drafted them. You hereby waive any and all defenses you may have based on the electronic form of these Terms of Use and the lack of signing by the parties hereto to execute these Terms of Use.
